Abstract

Claimant, a Russian company, entered into a sales contract with Respondent, a Chinese company. The contract was governed by the CISG, but the Arbitral Tribunal applied also the Civil Code of Russian Federation and the UNIDROIT Principles of International Commercial Contracts as a means of supplementing the CISG. The Arbitral Tribunal made reference to Articles 1.7 and 5.1.3 of the UNIDROIT Principles.
