Abstract
A contract between a French company and a Romanian company contained a choice-of-law-clause in favour of Romanian law. Nevertheless, when a dispute arose the Arbitral Tribunal, faced with questions concerning mistake and fraud, referred not only to the relevant provisions of Rumanian law, but also to those of French law and of the UNIDROIT Principles, the latter because "internationally recognised" (“internationalement reconnus”).
