BUYER'S OBLIGATION - PAYMENT OF PRICE (ART. 53 CISG)
Abstract
Between February 5, 2016, and November 15, 2017, a Slovenian company (seller) and a Uzbek company (buyer) entered into a contract for the supply of telecommunications equipment, valued at 71,295.76 Euros. The buyer paid 36,620.76 Euros, leaving an outstanding amount of 34,675 Euros.
The seller filed a claim with the Economic Court of Tashkent, demanding payment of the outstanding debt, penalties, and recovery of legal costs.
Based on Arts. 53, 54, 59 and 61 CISG, and pertinent domestic law provisions, the Court ruled in favor of the plaintiff and ordered the buyer to pay the principal debt plus contractual penalties and legal costs.
